IPR Amicus: November 2012

Governmental use of patented inventions and provisions of Sections 48 and 100 of the Patents Act, 1970 are analysed in the article on ‘Use of patented inventions by the government’. The news section contains draft guidelines issued by the Indian patent office on traditional knowledge and biological material related patents and IPAB observations that IP disputes are not just inter-partes and always an issue of public interest. Explaining various facets of Indian lP laws, IPR Amicus, November also summarises decisions on plurality of inventions, applicability of limitation act to post-grant opposition and revocation of patent on the ground that unpredictability of success cannot rule out obviousness.
