International Trade Amicus: June 2012

This first anniversary issue of the "International Trade Amicus" discusses India's measures to impose definitive anti-dumping duty retrospectively from the date of provisional levy after expiry of the latter. In WTO, USA's dolphin safe labels were found to be violative of the Technical Barriers to Trade (TBT) Agreement, while the US sought consultations with India over poultry import restrictions. Indian Commerce Ministry has introduced new Post-export Export Promotion Capital Goods (EPCG) scheme through the Annual supplement to India's Foreign Trade Policy. A new system of e-BRC has also been introduced. Under 'Ratio decidendi', Madras High Court in its landmark judgment has held that DGAD continues to have discretion to include within the term 'domestic industry', domestic producers who are also importers or are related to foreign exporters.
