The Insolvency and Bankruptcy Code (IBC) has made sweeping changes in the insolvency resolution landscape in India. This has brought lot of orderly behaviour in the way of conducting businesses and a sigh of relief to the banking sector. The recent decision of the Hon’ble Supreme Court in Swiss Ribbons case has once again confirmed that the legislation stands to the test of constitutionality.
The institutions to which the responsibility of implementing the Code are fairly new. However, so far they are successful in implementing the law. In this connection, it would be fit to relay the jurisprudence developed by NCLT/ NCLAT/ Supreme Court in this new field of law.
It is needless to mention that any sale of business by the resolution professional/ liquidator under the IBC proceedings involves Goods and Services Tax (GST) implications. Hence, there is a necessity to sensitize the industry about the emerging jurisprudence in the IBC and the relevance of GST on the IBC proceedings.
