Sunset Reviews: Whether mandatory?

Delhi High Court has recently answered in affirmative the question as to whether the Designated Authority must be satisfied that prima facie some case is made out before initiating the sunset review. According to the author, considering the fact that the Delhi High Court had earlier held that sunset review is mandatory and the Supreme Court decision in Kumho Petrochemicals did not expressly overrule the law laid down therein, the issue could have been referred to a Larger Bench. However, the decision of the Delhi High Court in the present case cannot be faulted with, as Rule 23(1B) of the Anti-Dumping Rules 1995 and Article 11.3 of the WTO’s Anti-dumping Agreement does provide that the request for a sunset review by the Domestic Industry must be ‘duly substantiated’…
