Session 1 - Competition law rule book for digital markets: The road ahead

This session will deep dive into the impact of the recent Competition Commission of India’s (CCI) judgments penalizing major digital/tech. companies for antitrust violations. These judgments mark a first in a series of several investigations into the conduct and business practices of digital market companies in India. The CCI has directed major behavioral changes and imposed prohibitive penalties. From defining the relevant market which is the touchstone for any competition law inquiry to the assessment of combined effect of ecosystems, and not to forget the considerations for imposition of penalty, there are many firsts. The consequences of the jurisprudence laid down by the CCI combined with the recently proposed amendments to the Competition Act can be far reaching on businesses. 

Session 2 - Digital Personal Data Protection Bill, 2022: Does it provide a free and fair digital economy?

This session will discuss the Digital Personal Data Protection Bill, 2022 published recently by the Ministry of Electronics and Information Technology. The Bill proposes to replace the Information Technology Act and rules thereunder and propose a framework for data privacy in India. In comparison to the minimal requirements under existing law, the Bill includes additional obligations surrounding collection (notice and consent) and processing (technical, security and organizational safeguards) of personal data implemented by Fiduciaries and Processors. It also proposes wider rights of data principals and specifies a framework governing international transfer of personal data. This session will highlight how does it fare with respect to the previous version(s) and to what extent it will factor as a compliance concern for digital businesses.
